These Terms govern:
- the use of Ateliervino
- any other Agreement or legal relationship with the Holder in a binding manner.

Introduction
This document constitutes a legal agreement between you, as a user, and the company that manages ATELIERVINO, and governs the use of the website and, in any case, the use of the services provided.
“Legal Agreement” means that the terms of this agreement, once accepted by the User, are binding on the latter.
REGISTRATION, CONTENT AND USE
Registration
By registering, Users provide truthfully and completely all the data requested in the corresponding registration form and fully accept the privacy policy and these general conditions.
The User is required to keep and preserve the confidentiality of his connection identifiers.
It is understood that the Holder cannot under any circumstances be held responsible in the event of loss, dissemination, theft or unauthorized use by third parties, for any reason whatsoever, of Users' access identifiers.
Account deletion and User account closure
Registered Users may deactivate their accounts, request their deletion or cease use of the Service at any time, via the Ateliervino interface or by contacting the Holder directly.
In the event of violation of these Conditions, the Holder reserves the right to suspend or terminate the User's account at any time and without notice.
The Holder reserves the right to suspend or delete the User's account at any time and without notice if he considers that:
  • the User has violated the Agreement; and or
  • access or use of the Service may cause damage to the Owner, other Users or third parties; and or
  • the User's use of Ateliervino may result in a violation of applicable law or regulations; and or
  • in the case of investigations carried out following legal actions or intervention by the public authority; and or
  • The account is considered by the Holder, in its sole discretion and for any reason, inappropriate or offensive or in violation of the Agreement or not in compliance with the Holder's standards.
Content available on Ateliervino
The contents available on Ateliervino are protected by copyright law and other laws and international treaties protecting intellectual property rights and, unless otherwise indicated, their use is authorized to Users only within the limits specified in this clause.
The Holder grants to the User, for the entire duration of the Contract, a personal, non-transferable and non-exclusive license, for personal and non-commercial purposes exclusive and limited to the device used by the User for the use of this content.
Therefore, the User is expressly prohibited from copying and/or downloading and/or sharing (except within the limits indicated below), modifying, publishing, transmitting, selling, sublicensing, processing, transferring/assigning to third parties or create derivative works in any way from the content, also of third parties, available on Ateliervino, nor allow third parties to do so through the User or their device, even at their own unknowingly.
If expressly indicated on Ateliervino, the User may be authorized to download and/or copy and/or share certain content made available on Ateliervino, provided that it faithfully contains all copyright and other indications provided by the Holder.
Unauthorized use
The Service must be used in accordance with the Terms.
Users cannot:
  • reverse engineer, decompile, disassemble, modify or create derivative works based on Ateliervino or any part thereof;
  • circumvent the computer systems used by Ateliervino or its licensors to protect content accessible through it;
  • copy, retain, modify, modify, prepare derivative works of, or in any way modify any content provided by Ateliervino;
  • use any robot, spider, search and/or site search application, or any other automatic device, process or means to access, retrieve, scrape or index any part of Ateliervino or its content;
  • hire, license or sublicense Ateliervino;
  • defame, offend, harass, threaten or otherwise violate the rights of others;
  • disseminate or publish illicit, obscene, illegitimate, defamatory or inappropriate content;
  • illegally hijack the account used by another User;
  • register or use the Service in order to approach Users to promote, sell or otherwise advertise products or services of any kind via Ateliervino;
  • use Ateliervino in any other inappropriate manner that violates the Terms.
CONDITIONS OF SALE
Purchase
Paid services
Ateliervino provides certain paid services.
The fees, duration and conditions of paid accounts and services are indicated in the corresponding section of Ateliervino.
Purchase procedure
Each order placed constitutes an offer to purchase the products. Orders are subject to availability and discretionary acceptance of the Holder.
The User must select the products and complete the check-out, after carefully checking the information contained in the order summary. The order is made by confirmation thereof and is subject to payment of the price and shipping costs, if provided, indicated in the order summary form.
The conclusion of the contract takes place at the time of sending the Order Confirmation by the Holder to the e-mail address provided by the User. The Holder reserves the right not to confirm an order, by informing the User within 5 working days of placing the order, at the e-mail address associated with its purchase, of the possible unavailability of a or more of the products purchased.
Payment terms
Ateliervino uses third-party tools for payment processing and does not under any circumstances come into contact with the payment data - such as credit card data - provided.
User's payment processing fees not accepted will be billed to the User.
Delivery
Deliveries are made during normal working hours to the address indicated by the User and according to the terms specified in the order summary.
Upon delivery, the User must check the content by specifying any anomalies in the delivery form within 8 days of receipt of the order.
In the event of non-collection within the time limit set by the carrier, the products will be returned to the Holder, who will reimburse the price of the products, but not the shipping costs. The Holder cannot be held responsible for delivery errors due to inaccuracies or incompleteness in the establishment of the order form by the User, for any damage that may occur to the Products after delivery to the carrier, if the latter has been chosen and mandated by the User or for delivery delays attributable to the latter.
Reservation of title
Until full payment of the price of the products ordered, the products remain the property of the Holder.
Product availability
Prices, descriptions or availability of products displayed are subject to change without notice. The photos you add are indicative and may not constitute an exact representation of the products. The Holder will do its best to present the characteristics of the products with the greatest possible detail on Ateliervino within each sheet corresponding to the product viewed by the User.
However, images and colors of products offered for sale on Ateliervino may differ from actual products due to several factors, including but not limited to user's terminal monitor, photo filters, etc. . Consequently, the User acknowledges and accepts that such minor differences do not constitute a lack of conformity of the products.
Execution of the Order
The Order is executed under the terms specified on the summary page and in the Order Confirmation email, subject to the availability of the product ordered. The Holder cannot be held responsible for damages suffered by the User due to delivery delays which are not dependent on circumstances foreseeable by the parties at the time of sending the Order Confirmation.
Conversion/Redemption
The Order is binding on www.ateliervino.com: the wines ordered cannot be exchanged or returned. Except for shipments that were damaged during transportation and/or delivery. We ask you to verify the accuracy and integrity of the delivery and submit any complaints, attaching specific documents, to us directly as soon as possible.
After 8 days from receipt of delivery, the Holder considers that everything is approved and correct.
Legislative references
In Switzerland, the federal law against unfair competition (LCSl; RS 241) and the ordinance on the indication of prices (OIP; RS 942.211) apply. In the European Union, electronic commerce is regulated by the Consumer Rights Directive (Directive 2011/83/EU) and the Electronic Commerce Directive (Directive 2000/31/EC).
